Public Offer Agreement

1. General Provisions

1.1The following text constitutes an Agreement between the online store, hereinafter referred to as the «Seller», and the user of the online store's services, regardless of status (individual, legal entity, or sole proprietor), hereinafter referred to as the «Buyer».
1.2This Agreement defines the conditions for purchasing products, hereinafter referred to as «Goods», by the Buyer through the Seller's online store.
1.3The Agreement is public pursuant to Art. 633 and Art. 641 of the Civil Code of Ukraine and is equivalent to a «verbal agreement» with full legal force.
1.4In accordance with Art. 642 of the Civil Code of Ukraine, full and unconditional acceptance of this offer agreement is confirmed by the Buyer's payment for the ordered goods.
1.5«Online Store» – the Seller's website for concluding retail and wholesale purchase agreements remotely. «Seller» – an organization or sole proprietor selling goods. «Goods» – products listed on the website. «Buyer» – an individual or legal entity placing an order. «Acceptance» – full and unconditional acceptance of the Agreement terms. «Order» – selected items specified by the Buyer when placing a request.

2.1The Seller sells Goods according to the current price list published on the website, and the Buyer pays for and accepts the Goods in accordance with the terms of this Agreement.

3.1Orders are accepted through the website during the Seller's working hours.
3.2Delivery costs are not included in the order price and are paid separately.
3.3All delivery options are listed in the «Delivery & Payment» section on the Seller's website.
3.4All goods are made to order within 2–5 business days. Production begins immediately after payment.
3.5When placing an order, the Buyer must provide accurate recipient details. Incorrect information may delay fulfillment.
3.6Payment of the order constitutes the Buyer's agreement to conclude this Agreement with the Seller.
3.7The Buyer pays by bank transfer to the Seller's account. The payment date is the day funds are received.
3.8Prices listed on the website are valid at the time of ordering.
3.9The Buyer may confirm or cancel the order before payment.
3.10Orders are fulfilled only after funds are received by the Seller.
3.11A payment confirmation is sent to the email address provided during checkout.
3.12Payment system and terminal fees are paid by the Buyer additionally.
3.13Delivery is carried out by postal services. The delivery method is selected by the Buyer at checkout.
3.14Changes to an order can be made before production begins. Once paid and produced, the order cannot be cancelled or changed.

4.1The Seller produces the order according to the Buyer's requirements.
4.2Production time is 2–5 days depending on complexity, quantity, and availability.
4.3If the appearance of goods differs from the website images, this is not a defect or grounds for a refund.
4.4In case of improper fulfillment due to the Seller's fault, refer to the «Claims» section on the website.
4.5All website materials are for reference only. For clarification before ordering, contact the store administrator.
4.6The order is considered fulfilled upon delivery to the Recipient or their authorized representative.
4.7The Agreement is valid from the moment of conclusion until the order is delivered.

5.1Custom-made or personalized goods are not subject to return or exchange.
5.2The Buyer may file a claim via the website feedback form or by email, providing a reason and photos of the defective item.
5.3In case of exchange or return, the Buyer must return the item in the same condition it was delivered.
5.4The Seller may refuse exchange or compensation if the reason is personal circumstances of the Buyer (allergy, etc.) that were not disclosed.
5.5If the Buyer cancels before shipping and the item has not yet been produced, a full refund is available.
5.6In other cases, the Seller reviews complaints within 3 business days and notifies the Buyer by email.
5.7If the Seller fails to ship within the agreed timeframe, the Buyer may claim compensation not exceeding the order amount.

6.1The Seller is the sole owner of the Trademark pursuant to Application No. m202323820 dated 12.12.2023.
6.2The certificate grants its owner the right to use the mark and other rights under the Law of Ukraine «On Protection of Rights to Marks for Goods and Services».
6.3Any infringement of the certificate owner's rights without consent is considered a violation subject to liability under current Ukrainian law.
6.4Legal use of the trademark requires prior written permission. Business entities may apply by email.
6.5The Seller holds exclusive copyright to all photographic and graphic materials on the website. Use of photos is permitted only with a backlink to the source.

7.1Acceptance of the Offer by the Buyer confirms conclusion of the Agreement.
7.2The Agreement takes effect from the moment of payment and remains valid until the Seller fulfills its obligations.
7.3The Seller may amend the Agreement at any time. The current version is always available on the website.
7.4Amendments to the Offer automatically apply to all existing Agreements.

8.1The Seller guarantees the confidentiality of information provided by the Buyer during registration or checkout.
8.2Personal data will not be used for commercial gain, shared with third parties, or used for spam.
8.3By placing an order, the Buyer consents to the processing of their personal data solely for order identification and fulfillment.

9.1The Seller bears all risks related to loss or damage of goods until delivery to the Buyer.
9.2The Recipient bears all risks from the moment of receiving the goods.
9.3The Seller may delegate fulfillment to third parties without being released from liability.
9.4The Seller is not responsible for improper use or storage of goods by the Buyer.
9.5Liability in other cases is determined in accordance with Ukrainian legislation.
9.6Disputes not resolved through negotiation shall be settled in accordance with current Ukrainian law.
